These Terms of Use ("Terms") govern your use of Moments: Smart Video Split and Editor ("Moments," "the app," "we," "us," or "our"). The app is provided by Nizameddin Tugral.

Acceptance

By downloading, accessing, or using Moments, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the app.

What the App Does

Moments helps you import selected videos, analyze them for scenes and moments, split clips, create edit timelines, and export edited videos. Some features use cloud-based AI analysis.

Your Content

You keep ownership of videos, audio, images, projects, and other content you import or create with the app. You grant us a limited permission to process selected content only as needed to provide app features, including uploading selected videos for AI analysis when you choose those features.

You are responsible for having the rights and permissions needed to use, edit, upload, export, and share your content.

AI Analysis

AI-generated scene labels, summaries, split points, edit decisions, and other outputs may be incomplete, inaccurate, or unsuitable for your intended use. You are responsible for reviewing all edits before exporting or publishing a video.

Do not use Moments to upload or process content that is illegal, harmful, infringing, or that you do not have the right to process.

Subscriptions and Credits

Moments may offer auto-renewable subscriptions and consumable credit packs through Apple In-App Purchase. Subscription plans may include monthly video analysis minutes. Video analysis minutes are generally measured by the length of video submitted for AI analysis, not by the time you spend editing.

Credit packs may provide additional video analysis minutes when your monthly plan allowance is used. Available plans, prices, renewal periods, included minutes, and credit pack amounts are shown in the app or on the App Store product page and may change as permitted by Apple and applicable law.

Purchases are billed by Apple. You can manage or cancel subscriptions through your Apple Account settings. Unless Apple provides otherwise, subscriptions renew automatically until canceled at least 24 hours before the end of the current billing period. Refund requests are handled by Apple under Apple policies.

Acceptable Use

You agree not to:

• Use the app for illegal, abusive, deceptive, or infringing activity.
• Upload content that violates someone else's rights, privacy, or publicity rights.
• Attempt to bypass usage limits, payment requirements, App Check, security controls, or backend rate limits.
• Reverse engineer, scrape, overload, or interfere with the app or backend service except where legally permitted.
• Use AI outputs as a substitute for professional, legal, safety, or compliance review.

Availability and Changes

We may update, suspend, limit, or discontinue any part of the app or backend service. Cloud AI features depend on network access, App Store purchase status, third-party services, and backend capacity, and may not always be available.

Privacy

Our Privacy Policy explains how information is handled. By using the app, you also agree to the practices described in the Privacy Policy.

Intellectual Property

The app, software, design, trademarks, and service technology are owned by us or our licensors. These Terms do not transfer ownership of the app or service technology to you.

Disclaimers

Moments is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and error-free operation.

Limitation of Liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost content, or business interruption arising from your use of the app.

Apple Terms

If you downloaded Moments from the Apple App Store, Apple and its subsidiaries are third-party beneficiaries of these Terms where applicable. Apple is not responsible for maintaining or supporting the app. Your use of the app is also subject to Apple Media Services Terms and any applicable App Store terms.

Termination

We may suspend or terminate access to cloud features if you violate these Terms, create security risk, misuse the service, or if required by law or platform rules.

Governing Law

These Terms are governed by the laws of Turkey, excluding conflict-of-law rules, unless applicable consumer protection laws require otherwise.
